What Louisiana courts consider when determining child custody

When parents get divorced, one of the most difficult issues to resolve is child custody. In Louisiana, there are a number of factors that the court will consider when making a determination about child custody, and understanding them is critical to ensuring that the best interests of the child are met.

Overall health of the child

The health of the child is a significant consideration. If a child has special needs, for example, it may be in their best interests for the parent who is better equipped to care for them to get child custody.

Proximity to doctor’s offices, health facilities and pharmacies becomes important as does who is better versed in the child’s health conditions. If the child does not have chronic health issues, this is less of a concern.

Relationship between the child and each parent

The court will also consider the relationship between the child and each parent when making a custody determination. If one parent has been more involved in the child’s life or if the child has a stronger bond with one parent, that may be taken into consideration.

Each parent’s ability to provide a stable home environment

This includes factors such as consistent employment, financial stability and the presence of any other children in the home. If one parent is able to provide a more stable and secure home environment, that may be given more weight by the court.

Each parent’s ability to care for the child’s physical and emotional needs

If one parent is better able to meet the child’s physical and emotional needs, that may be taken into consideration. This includes things like the ability to provide a loving home, to be emotionally supportive and to be physically present for the child.

While there are many factors that the court will consider when making a child custody determination, the child’s best interests are always the primary concern.
